Trademark Registration Process

  • Filing of application
  • Issuance of Acknowledgement Receipt

Cash  receipt  and  trademark  number  is  allotted  to  the  applicant  when  the  application is received;

The  Acknowledgement  Receipt  by  the  Trade  Marks  Registry  is  issued  to  the  applicant within 10-15 days of filing an application;

Examination Report is generated after 3 months of filing an application. If there are any objections on the applied trademark, they are communicated to the applicant immediately in the  form  of a Show Cause  Notice.  The applicant  is  required  to  submit  a  reply  within two months from the date of issuance of a Show Cause Notice;

If there are no objections, the application will be published in the Trade Marks Journal. If no oppositions  are  filed  to  the  published  application  within  two  months  from  date  of publication  of  the  Trade  Marks  Journal,  the  application  stands  accepted  and  Demand Notice  is  issued  to  the  applicant  requesting  him/her  to  submit  Form  TM-11  along  with registration  fee  amounting  to  Rs.  9,000/-  from  scheduled  bank  in  form  of  a  pay  order/bank draft in the name of Director General IPO-Pakistan for issuance of the Registration Certificate; and

On the receipt of registration fee, the Registration Certificate is issued by the Registrar of Trademarks.

Following details and documents are required for trademark registration in Pakistan:

Personal Details

  • Copy of CNIC
  • Cell No. and Email
  • Official Address

Business Details

  • Business Type (i.e. Sole Proprietor, Private Company, Firm etc.)
  • Business Name
  • Business Address
  • Period to use Trademark (since when the trademark is being in use), OR
  • Proposed to be used (from when the trademark will be used)

Logo / Mark Details

  • Mark Type (Design Mark / Word Mark / Both)
  • Mark Description (Name of logo etc.)
  • Mark Series ( Do the company use the same trademark for other products)
  • Domain Name (either the Goods or Services)
  • Color claim of logo/mark (if any)
  • JPG file of logo/mark (maximum size 500kb)
Importance of Trademark Registration

There are seven reasons that you should trademark your brand or business name or logo or whatever it might be.

  1. It protects your brand if you trademark your brand or your business name or your logo. It protects your brand from competitors coming in and trying to steal your brand or trying to make counterfeit goods or do things like that. It’s a very inexpensive way to protect your business in the event that somebody tries to copy what you’re doing.
  2. Second reason that you want to trademark your business or brand is that it isn’t an extremely inexpensive way to invest in your business because filing fees are low. You basically can register your trademark with the IPO by adopting our expert services or if you want to do it by yourself then do it yourself.
  3. Third reason you want to trademark your brand is that once its trademark you can legitimately claim and use it anywhere as an identity of your brand in the general public. There’s a company that owns that registered trademark and they have actually filed for and received protection with the IPO Office. It will give your brand a little bit of legitimacy knowing that it’s trademarked so that nobody’s going to come in because the brand is protected.
  4. If you are doing some sort of e-commerce business specifically maybe even selling on Amazon, if you register your trademark for your brand you can file that trademark with customs department so they can’t block goods/products from coming into the Pakistan that would be infringing on your trademark or that might be counterfeit goods for your brand so that is a huge benefit to registering your trademark specifically if you’re doing aim to have an e-commerce business and you’re worried about copycat sellers.
  5. This increases the value of the products or services you offer under that brand and if you decide that someday you want to sell a brand’s products by registering the trademarks that’s going to greatly enhance the value of your brand and products. If you’re looking to sell your business at some point in the future and when a buyer comes in, part of their due diligence is seeing whether or not the brand is a trademark. If it is not trademarked they want to see that the brand gets trademarked before they’re willing to buy.
  6. Sixth reason that you want to register your trademark is once you’ve done so you can go ahead and sue somebody that has some fringes on your brand in court. I know that doesn’t seem like a big deal but it is a big deal because some of these lawsuits can be worth hundreds of thousands of dollars because you’re allowed to get special damages and lawyer’s fees.
  7. Last reason we’ve got is that by registering your brand it’s gonna prevent somebody else from coming in and registering a brand that might be confusingly or similar to you because what can happen is if somebody comes in and they see your brand is doing really well and they want to register something that’s similar but IPO Office will do a search and they still may decline registration of that brand that might be confusingly similar to yours.
