Divorce Registration Certificate

Divorce is a sensitive matter as it ends the relationship of marriage between the spouses so it must be followed with due care and probably through an expert lawyer who guides according to the State and Sharia laws. Divorce also known as dissolution of marriage is the termination of a marriage, the canceling and/or reorganizing of the legal duties and responsibilities of marriage, thus dissolving the bonds of matrimony between a married couple under the rule of law of the particular country and/or state.

Divorce Registration Certificate Requirements

In Pakistan, divorce is followed by the principles of Sharia, and it must be registered according to the state laws. There is a certain procedure of divorce in Pakistan which every person must have to follow and failure to do so may cause penal action.

  • Divorce must be in written form. However, writing on a stamp paper is not mandatory but signifies the validity of the deed.
  • Divorce deed must be in a form of deed written by an expert lawyer.
  • Contents of the divorce deed requires professional writing so as to avoid future consequences.
  • Divorce deed must contain the reasons and liabilities with respect to the dower amount.
  • Three copies of the deed be prepared, and each copy shall be forwarded to the Chairman Union Council along with notice under section 07, another copy shall be forwarded to the wife.
  • Divorce deed must be notarized by the Notary Public Officer.

Procedure to Get Divorce Certificate

Below is the Nadra divorce certificate procedure in Pakistan.

  1. Prepare a divorce deed
  2. Send the divorce deed to the arbitration council and wife
  3. Attend the proceedings of the arbitration council
  4. Two family member representatives from both sides will be appointed by the husband and wife
  5. Reconciliation proceedings of at least 90 days will be conducted. There is no limit to the maximum time
  6. At least for 90 days, the arbitration council will try to have reconciliation between husband and wife
  7. In case the reconciliation fails after 90 days the divorce certificate Nadra will be issued
